Who are we?

Driveyouaway.com ( "us", "we" or “our” as the context requires) is a Greek business providing instant online car search (the "Driveyourway.com Services”) to users throughout the world via our website.

Driveyouaway.com is not a travel agent and is not responsible for providing, or for setting or controlling the prices applicable to, any of the cars which you may search for, find on and/or book via the Driveyouaway.com Services and Platforms (“Third Party Car Services”). All such Third Party Car Services are provided by independent agents  and car rental service providers and are subject to the terms and conditions imposed by those third parties.

The Driveyouaway.com Services are provided by Driveyouaway.com, a website registered in Greece. Our company details, including correspondence address are: Rodou-Lindou Avenue, number 255, Rhodes, PC 85100.

Terms and Conditions

These terms and conditions ("Terms") govern your access to and use of the our Services and, together with our privacy policy, constitute a legal agreement between you and us. By downloading, accessing or otherwise using our Services and/or our website, you are confirming that you have read, understood and agreed to these Terms and those of the privacy policy.

We may amend these Terms at any time at our discretion. If these Terms are amended, we shall display the revised terms and conditions on or via our website and you will be deemed to have accepted any amendments if you continue using the our Services after the amendments are displayed.

If you do not accept all of these Terms then you should not use this website or any of the services we provide.

Using our Services

You may only use our Services in compliance with applicable laws and for legitimate purposes. In consideration of you agreeing to abide by these Terms, we grant you a non-transferable, non-exclusive licence to download, access and use our services for your own personal, non-commercial purposes and for no other purpose. In particular, we grant such licence to you subject to you agreeing that you shall not:

a) use our Services for any purpose that is improper, unlawful, or to post, share or transmit any material that

(i) is defamatory, offensive, obscene or otherwise objectionable;

(ii) is in breach of confidence or privacy or of any third party’s rights including copyright, trade mark or other intellectual property rights;

(iii) is posted, shared or transmitted for the purpose of advertising or promoting yourself or any third party; or

(iv) is misleading or misrepresentative as to your identity or which in any way suggests that you are sponsored, affiliated or connected with us;

 

b) use our Services for any commercial purpose or in any manner which may cause damage to  us or bring  us into disrepute;

c) disassemble, reverse engineer or otherwise decompile any software, applications, updates or hardware contained in or available via our Services, except as permitted by law;

d) copy, distribute, communicate to the public, sell, rent, lend or otherwise use our Services, or seek to violate or circumvent any security measures employed to prevent or limit your access to or use of our Services;

e) use or interfere with our Services in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users;

f) introduce onto, or transmit via, the driveyouaway.com Services any disruptive computer program code, virus, ‘denial of service’ or ‘spam’ attack, worm, Trojan horse, authorisation key, licence control utility or software lock;

g) remove, alter or replace any notices of authorship, trademarks, business names, logos or other designations of origin on our Services or pass off or attempt to pass off our Services as the product of anyone other than driveyouaway.com;

h) use any automated computer program or application to scan, copy, index, sort or otherwise exploit our Services or any part thereof.

Password Protection

Where you sign up to any feature of, or use, our Services that requires the use of a log-in account or password, you agree that you shall be responsible for keeping those password and log-in details confidential and secure. If you become aware, or suspect for any reason, that the security of your log-in details has been compromised, please let us know by sending us an email at i[email protected] as soon as you can.

Minors

Our website is not intended for children under 18 years of age, and no one under the age of 18 may provide any information to, on or via our Services. We do not knowingly collect personal information from children under 18, and if we learn that we have collected or received personal information from a child under 18, we will delete that information in accordance with our privacy policy.

Third Party Website

To the extent that any element of our Website is hosted on a third party website (for example, Facebook or another social media website) and there are separate terms and conditions of use relating to that third party website, you agree to fully comply with such terms and conditions.

Sharing information with us

We take your privacy seriously and operate at all times in accordance with applicable data protection laws. You acknowledge that any personally identifiable information which you submit to or via our Website may be used by us in accordance with our privacy policy. You agree to ensure that all personally identifiable information you provide to us is accurate and up to date and that you have obtained all consents, licenses or approvals necessary to enable us to use that information in accordance with these Terms and with our privacy policy.

To the extent that our website allow you to post, upload, transmit or otherwise make available any information, images, video, or other data with driveyouaway.com or other driveyouaway.com users (“User Content”), you agree that:

a) you are solely responsible for the User Content that you upload and you represent and agree that you will not share anything which you do not have the permission or right to share and which you cannot grant the licence referred to in paragraph (b) below in respect of;

b) although all intellectual property rights subsisting in any User Content will be owned by you or your licensors, you hereby grant driveyouaway.com a non-exclusive, perpetual, royalty-free, worldwide, transferrable and sub-licensable right to use, reproduce both electronically and otherwise, display, distribute, modify, adapt, publish, translate, and create derivative works from any and all such User Content (excluding personally identifiable information) including for the purposes of advertising and marketing our website and our Services;

c) we are under no obligation to store, retain, publish or make available any User Content uploaded by you and that you shall be responsible for creating backups of any such User Content if necessary.

To the extent that you provide us with any suggestions, comments, improvements, ideas or other feedback (“Feedback”), you hereby assign ownership of all intellectual property rights subsisting in that feedback to us and acknowledge that we can use and share such Feedback for any purpose at our discretion. BOOKING POLICY

What is included in the price

According to the car rental service provider's policy you may be offered the following at no cost:

Collision Damage Waiver (CDW) Collision Damage Waiver reduces the renter's liability from the total cost of the damage to an excess amount, where applicable, unless the renter intentionally causes the damage, is under the influence of drink or drugs, or uses the car in a prohibited or negligent way – such as driving off main roads or hiring to other parties. CDW covers liability for damage to the car or its parts. In most locations, windscreens, tyres, undercarriage, replacement locks, replacement keys and towing charges are not covered under the CDW policy. Other exclusions may apply and can differ between car hire companies, so we recommend checking these exclusions with the car hire company when picking the car up.

Theft Protection (TP) Theft Protection reduces the renter's liability in the event of theft or damage caused due to theft or attempted theft of the car to an excess amount, where applicable. Negligence connected with the theft of/damage to the car may lead to the car hire company requiring the full amount for the cost of the car.

We will try to ensure that the renter will get the minimum standards of protection. However, we cannot guarantee that the collision damage waiver (CDW) and the theft protection (TP) could be offered to you at no extra cost by the car rental service providers.

IMPORTANT NOTE: Please check carefully the details of the cover provided by the car hire company. It is not unusual for third-party cover to exclude members of your immediate family or members of the same home address who travel with you, the renter, in the car. Top-up policies will normally be available to purchase directly from the car hire company, or such cover may already be included in your holiday insurance. For peace of mind, we strongly recommend that you, the renter, familiarise yourself fully with the extent of the cover provided with any rental and, where necessary, take out additional cover in respect of your spouse and any children or close relatives who will be accompanying you in the car.

What is not included in the price

Fuel: Fuel charges are not included in the price. Most car hire companies will require you to return the car with the same amount of fuel it had in the tank at pick-up. Others operate a fuel policy where you, the renter, must purchase the first tank of fuel and may drop the car off empty – in which case, there may be no refund for unused fuel.

Where the car hire company charges for fuel, the cost may be higher than it would be at a local petrol station.

Personal Accident Insurance (PAI): This optional insurance may be covered by your holiday insurance (please check before you, the renter, travel). If you require PAI, it can be purchased at the car hire counter when you pick the car up.

Out-of-Hours Service At most airport locations, flights will be met and cars supplied outside normal working hours. However, there may be an additional charge for this service, which will be payable directly to the car hire company. We will advise you, the renter, whether a charge will apply when you confirm your pick-up times in your booking request. In the event that a flight delay causes the car pick-up to fall outside a car hire company’s normal working hours, the car hire company may agree to provide an out-of-hours service – in which case they will advise you of any fee. We can accept no further responsibility where there is no out-of-hours service available – and it is therefore recommended that you, the renter, take independent travel insurance. Non-airport car hire counters may also provide an out-of-hours service.

Additional Drivers Fees may apply for additional drivers, payable at the car hire counter (unless otherwise specified on the voucher / eVoucher). Please check with our Contact Centre.

Late Pick-ups / Early Drop-offs Your rental starts and finishes according to the pick-up and drop-off dates and times detailed on your voucher / eVoucher. Unfortunately, we are unable to provide refunds for unused time if a car is picked up late or dropped off early. If you are unable to pick the car up at the agreed time and date, it is essential you contact us as soon as possible. If you do not, there is no guarantee that the car will still be available – and you will not be entitled to any refund.

Child Seats & Special Requests Child seats, roof racks (not available on some cars) and other ‘extra’ items are available on request in most locations, although they cannot be guaranteed. There is usually a fee payable to the car hire company. In most locations, child seats are required by law. Please note: rear seatbelts may not be provided in all cars. Requests for these items should be made at the time of booking.

Car Capacity & Car Class All cars are insured for a maximum number of passengers. We cannot accept liability for the car being unsuitable for all passengers and luggage. As a guide, please refer to the driveyouaway.com website for approximate capacities of the various car classes. We cannot accept responsibility if the car hire company refuses to supply a car because the party size is too big.

We are unable to guarantee a particular make or model of car. The car shown on your voucher / eVoucher is for guidance only and the car hire company may instead provide a different car which is deemed to be similar or superior.

Mechanical Difficulties / Accidents: In the case of breakdown or mechanical difficulties, you, the renter, must call the car hire company immediately. The car hire company must give authority for repairs or replacement cars. If you, the renter, are involved in an accident, the local police and the car hire company must be contacted. Keep copies of all relevant documentation you are asked to complete. This may be needed if you, the renter, wish to make a claim.

Complaints
If you, the renter, are dissatisfied in any way with your rental, please report this to the car hire company as soon as feasible. It is difficult for us to assess any claim regarding your rental if this action is not taken at the time. If you, the renter, wish to make a complaint, please ensure you contact our Customer Service Team at [email protected] within 3 months of dropping the car off. We know that on occasion, you may feel that your complaint has not been resolved to your full satisfaction, so if you are not happy about the way in which we have handled your complaint, you may refer your complaint to an independent Alternative Dispute Resolution (ADR) provider;

Terms of Your Contract with us

However you, the renter, choose to book, it is important to understand how and when a contract is formed. The technical steps required for a contract to be formed are as follows. When we place our services/prices on our website, we are inviting you, the renter, to make an offer for their purchase. You, the renter, do not make this offer until you do so by clicking ‘CONFIRM THIS BOOKING’ on our ‘Payment Details’ page.

You, the renter, will have made us an offer to purchase the services once you have done so by clicking ‘Book Now’. We will have accepted this offer once we have both received the necessary payment and made your voucher / eVoucher available to you, the renter. Where the arrangement with the car hire company is for us to act as an agent, acceptance of your offer is by us as agent on behalf of the car hire company.

We have the right to cancel a booking upon limited or immediate notice in certain circumstances, such as the insolvency of a car hire company. In all circumstances we will use our reasonable endeavours to arrange for the supply of an alternative car, but at periods of high demand it may not be possible.

Changes to your booking

By the renter: No charge will be made for amending your booking before the start of your rental. This excludes any cost increases caused by a material change to the booking, such as its duration or the car class – or by the car hire company changing its rates following the original booking. With certain car hire companies, amending the driver’s name or the pick-up location may require the cancellation and re-booking of a rental. To cancel your booking, please log in to the Amend/Cancel Booking facility, and click Cancel Booking. Terms & conditions vary per car hire company and will be clearly communicated during the booking process.

If We Make Changes to Your Booking Occasionally it may be necessary for changes to be made to your booking (after acceptance) by us or by the car hire company. In all such cases we will advise you, the renter, as soon as reasonably possible before pick-up and, if the proposed changes are unacceptable, you will be offered a full refund. However, in such circumstances, we shall have no additional liability in respect of any direct or indirect losses you may suffer as a result of such changes.

Our Intellectual Property rights

Except as set out elsewhere in these Terms, all intellectual property rights including, but not limited to, copyright (including copyright in computer software), patents, trademarks or business names, design rights, database rights, know-how, trade secrets and rights of confidence in our website (together, the "Intellectual Property Rights") are owned by or licensed to driveyouaway.com. You acknowledge that by using our Services, you will not acquire any right, title or interest in or to our Services or in or to the Intellectual Property Rights except for the limited licence to use our Services granted to you pursuant to these Terms. You further acknowledge that you have no right to have access to any aspect of driveyouaway.com in source-code form.

While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through this Site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Site.

Other people’s property

We respect the intellectual property rights of others. If you have reason to believe that your copyright is being infringed by any content on our website, please send a written notification of such infringement to our email address [email protected] marked for the attention of our "Legal Department".

Acceptable Use

You may only use this Site to make legitimate reservations, purchases or requests to purchase the products or services offered and shall not use this Site to make any speculative, false or fraudulent Requests or any Requests in anticipation of demand. You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this Site. You agree to provide correct and true information in connection with your use of this Site and you agree to promptly update your membership information (if applicable) in order to keep it current, complete and accurate. It is a violation of law to place a Request in a false name or with an invalid method of payment. Fraudulent users will be prosecuted to the fullest extent of the law.

Price accuracy and warranty disclaimer

The use of our website and services is entirely at your own risk.

Although we enforce strict ‘price accuracy’ policies with all partners who provide us with rental data and endeavour to ensure that the content displayed on or via our website is up to date and accurate, we cannot guarantee the reliability or accuracy of such content. We expressly disclaim all warranties, conditions and guarantees of any kind, whether express or implied, including but not limited to, the implied warranties of title, non-infringement, merchantability and accuracy, as well as any warranties implied by usage of trade, course of dealing or course of performance. To the extent permitted by law, we make no representations and do not warrant to you that our Services (a) are accurate, complete or up to date; (b) will always be available; (c) will meet your expectations; or (d) are secure or are free from errors, faults, defects, viruses or malware.

Making car bookings via driveyouaway.com

We are not a travel agent and we are not responsible for providing any travel options displayed via our Services or for setting or controlling the prices we display. Any Third Party Car rental Services which you find and/or book via our website are provided by independent car rental service providers and agents, or other third parties. Our website facilitates your bookings with Car Rental Service Providers but is not responsible and has no liability to you in respect of such bookings. The identity of the relevant Car Rental Service Provider and the terms and conditions applicable to your booking with them will be notified to you at the time of booking and you should ensure that you read and fully understand them before completing your booking. You agree to comply in full with all applicable Car Rental Service Provider Terms. You acknowledge that breaching these Terms could result in the cancellation of  reservations/bookings, revocation of any other benefits, and additional charges.

Limitations and exclusions of liability

These Terms set out the full extent of our website's obligations and liabilities in respect of our Services.

Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

You may see advertising material submitted by third parties on our website. Each individual advertiser is solely responsible for the content of its advertising material and driveyouaway.com accepts no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein.

To the maximum extent permitted by law, we (together with our officers, directors, employees, representatives, affiliates, providers and third parties) do not accept any liability for (a) any inaccuracies or omissions in the content displayed on or via our website; or (b) any act of god, accident, delay or any special, exemplary, punitive, indirect, incidental or consequential loss or damage of any kind (including, without limitation, lost profits or lost savings), whether based in contract, tort (including negligence), strict liability or otherwise, incurred by you arising out of or in connection with your access to, use of, or inability to access or use, our Website and/or Services or any content contained provided therein.

Subject to these Terms and to the extent permitted by law, our maximum aggregate liability to you arising out of or in connection with these Terms or your access to, use of, or inability to access or use,  driveyouaway.com shall be limited to the sum of €50 (fifty Euro).

Nothing in these Terms shall limit or exclude (a) our liability in respect of death or personal injury caused by our negligence or for our fraud or fraudulent misrepresentation; (b) any other liability that cannot be excluded by law; or (c) your statutory rights.

Indemnification

You agree to defend and indemnify driveyouaway.com, their affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought (i) by you or on behalf of you in excess of the liability described above, within the limits permitted by applicable law; or (ii) by third parties as a result of:

  1. your breach of this Agreement
  2. your violation of any law or the rights of a third party; or
  3. your use of this Site in violation of the terms and conditions set forth herein

Third Parties

If you use this Site to submit Requests for or on behalf of a third-party (“Third-party”), such as a family member or a traveling companion, you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the Third-party of all Terms and Conditions applicable to all products or services acquired through this Site including all rules and restrictions applicable thereto. Each User using this Site for or on behalf of a Third-party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third-party’s or the User’s failure to fulfill any of its obligations as described above. You are directly responsible for any Request submitted including for total charges and performance obligations.

Termination

It is in our absolute discretion immediately terminate any agreement with you under these Terms at any time upon notice to you and/or, if you have a log-in account, by cancelling your membership and your access to your account. Driveyouaway.com may suspend your use of  our Services without notice at any time, without incurring any liability to you whatsoever.

General provisions

You acknowledge that your unauthorised use of our Services may result in irreparable damage and injury to driveyouaway.com and/or its affiliates or licensors for which money damages would be inadequate. Consequently, in the event of such unauthorised use, we and our affiliates and/or licensors (as applicable) shall have the right, in addition to any other legal remedies available, to seek an immediate injunction against you prohibiting any further use of  our Service.

The invalidity or unenforceability of any provision (in whole or part) of these Terms shall not affect the validity or enforceability of the remaining provisions (in whole or part). The whole or part of any provision which is held by a court of competent jurisdiction to be invalid or unenforceable shall be deemed deleted from these Terms.

These Terms are personal to you. You shall not be entitled to assign these Terms in whole or in part to any third party without our prior written consent.

These Terms represent the entire agreement between us and you and supersede and replace all and any previous terms, conditions, agreements and arrangements in respect of your use of  our Services.

We will act promptly to any indications of User Content that is in breach of these Terms. Where you know of or suspect any illegal activities, or know of or suspect that works belonging to you have been infringed, please write to us at our email address [email protected] marked for the attention of our "Legal Department".

To the extent that we need to contact you, you agree that we may do so via any electronic means, including but not limited to communications posted on this Site or electronic mail.

Any failure by us to enforce any of these Terms shall not be considered to be a waiver of them or the right to subsequently enforce any of these Terms.

A person who is not a party to these Terms shall have no right to enforce any provision of these Terms.

Irrespective of the country from which you access or use our Website and Services, to the extent permitted by law these Terms and your use of our Services shall be governed in accordance with the laws of  Greece and you are deemed to have submitted to the non-exclusive jurisdiction of the courts of Rhodes, Greece to resolve any disputes which may arise hereunder.
